TERMS OF USE

When you sign up for use of America’s Leading Lawyers (“ALL”) service, you agree to all of the following terms. This Agreement incorporates by reference our Privacy Statement and our Disclaimer Policy.

Please read the following terms and conditions carefully, as they form the agreement between us. If you do not agree to these terms and conditions, you may not use our service and should not proceed to register.  By using the Service after January 10, 2005 you are agreeing to be bound by this Agreement, including all amendments made to date. Terms and conditions of this agreement are subject to change, at any time, effective upon notice to you. Notice is deemed to have been provided when we post the current version of this Agreement on our website.

1. User Agreement.

This Agreement constitutes your agreement with America’s Leading Lawyers (“ALL”) with respect to your use of the Service. You must agree to abide by all of the terms and conditions contained in this Agreement in order to become or remain an authorized user of the Service. As used in this Agreement, "we", "us" and “our” means America’s Leading Lawyers or any successor or assign of America’s Leading Lawyers.

2. The Service.

America’s Leading Lawyers (“ALL”) provides a venue that facilitates communication between legal professionals and potential users of legal services.  ALL does not guarantee that the user will successfully find an attorney through this system nor does ALL involve itself in any agreement between attorneys and users or the actual representation of users nor does ALL practice law or make any opinion about the merits of any matter submitted to its service.  ALL does not ensure the completion of the agreement or the integrity of either party. The User, and not America’s Leading Lawyers is responsible for assessing the integrity, honesty, and trustworthiness of all persons with whom the User communicates on and off the ALL website.
ALL does not screen or vouch for any of its users. ALL further does not make any representations about the attorney’s qualifications or certifications. America’s Leading Lawyers disclaims any liability that may arise from representation, guarantee, or warranty, as to the legal ability, competence, or quality of representation provided for by attorneys using this website.
ALL is not responsible for the material posted on the Message Board.  America’s Leading Lawyers does not review nor verify any content that is posted.  The burden is upon the User and the Attorney to follow commonsense rules and guidelines when dealing with another person.  The User and Attorney may not use grossly offensive language, including but not limited to, racism, prejudice, or bigotry.  See Paragraph 8 for our Code of Conduct. It is the user’s responsibility to evaluate the information posted. The User should not take any statement set forth as facts but should make their own inquiry into the truth of any statement asserted.

3. Right to Use.

Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may change, suspend or discontinue any aspect of our Service at any time, without notice or liability, including the availability of any Service feature, database or content. We may further impose limitations on aspects of our Service or restrict your access to parts or all of our Service without notice or liability, if you fail to comply with the Terms of Use.

4. Disclaimer of Attorney - Client Relationship.

The use of this service is not intended and will not create an attorney-client relationship between any person or entity of America’s Leading Lawyers. ALL does not ensure the licensing or fitness to practice law of any attorney using this website.

5. No Legal Advice.

America’s Leading Lawyers does not offer any advice on whether you may have a legal remedy for your complaint or injustice, and makes no representation or guarantee that you will obtain satisfaction, justice or compensation for your complaint or injustice. America’s Leading Lawyers is not obligated to release any posted information, including contact names. America’s Leading Lawyers does not offer any opinion whatsoever concerning the merits of any claim you might have. America’s Leading Lawyers encourages you to supplement information obtained through the use of our service by contacting another attorney, if you intend to pursue any claims, and should do so promptly so as to avoid being barred by any and all applicable statute of limitations.

6. America’s Leading Lawyers does not guarantee the confidentiality of the information disclosed by the User on this website.

Please use caution in deciding what information to reveal on this website.  Do not make any confessions, admissions or any other highly sensitive information.  America’s Leading Lawyers disclaims any liability arising from the release of information by an intruder or third party user.

*7. Anonymity.

Certain legal matters require a degree of expertise not ordinarily possessed by the average attorney. In light of this recognition, and in order to properly meet your legal needs, an attorney skilled in one of these areas will be assigned. This cannot be done anonymously, and will require specific contact information prior to assignment.  Your submission will not be complete unless such information ahs been disclosed.  

8. Code of Conduct

You agree to the use of our Service in accordance with the following conduct:

• You will not use our Service to harass, insult, or injure any other person, group, or entity.
• You will not use our Service to promote or provide any offensive pamphlets or brochures.
• You will not use language that is racist, prejudicial, bigoted or vulgar.
• You will not use our Service to solicit, advertise, or market any material unrelated to the purpose of the Service.
• You will not intrude nor attempt to intrude into the security of America’s Leading Lawyers or gain access into unauthorized areas of our website.  

9. Monitoring & Termination

We reserve the right to monitor all messages to ensure that they conform to the content guidelines which may be applicable from time to time. We further reserve the right to terminate your use of our Service with cause or if you have violated any provisions of this Agreement, without notice.

10. Indemnification

The User acknowledges, agrees and holds America’s Leading Lawyers, its successors and assignees, its agents, affiliates, officers and employees, harmless from any claims or demands that may result from the use of this Service. The User further agrees that it will indemnify America’s Leading Lawyers for any liability, costs or expenses, including attorney fees and costs, incurred from loss, liability, and/or claims in defending or arising from use or in connection to the substance and use of our service, including reasonable attorneys’ fees made by any third party due to or arising out of the content that you submit, post, transmit or make available through our Service, your use of our Service, you connection to the Service, your violation of the Terms of Use, or your violation of the rights of another. The User further indemnifies America’s Leading Lawyers for any costs or expenses associated with a breach of the User Agreement.

11. Agreement to Arbitrate

The parties agree that any case, controversy or claim arising out of or relating to this Agreement, use of the Service or any other transaction between the parties shall be settled by binding arbitration prescribed in accordance with commercial arbitration rules of the American Arbitration Association (“AAA”).  The arbitrator’s decision shall be binding and will preclude the parties from thereafter litigating the same claims or controversies that arise out of or relate to this Agreement, use of the Service or any other transactions between the parties, in a court of law.  The arbitration shall be conducted in the County of New York in New York State, and judgment may be confirmed in any court of competent jurisdiction. In appropriate cases, either party has the option to make use of the applicable small claims court in lieu of a binding arbitration as described in this paragraph.
